WHAT IS A HEALTH CARE PROXY?

A Healthcare Proxy (aka Health Care Power of Attorney) is a type of Advance Directive that allows you (the “Principal”) to appoint a third party (the “Agent”) to make medical decisions on your behalf.

WHAT IS A HEALTH CARE PROXY USED FOR?

If you are incapacitated and unable to make health care decisions yourself, your agent may do so. A health care proxy can help make sure that health care providers follow your wishes during your treatment. Your proxy can also make decisions about how those wishes apply as your medical condition changes. A key benefit to appointing a health care proxy is that it limits potential disagreements between your family members about your care and their interpretation of your wishes.

HOW MUCH IS A HEALTH CARE PROXY?

We charge $200 for an individual Health Care Proxy and $325 for married couples.

HEALTH CARE PROXY VS POWER OF ATTORNEY

While both documents include a principal and agent, each serve different purposes. A Power of Attorney (financial) allows an agent to conduct financial business on behalf of the principal. A Healthcare Proxy allows an agent to make health care decisions on behalf of the principal when the principal cannot make those decisions him or herself.

HEALTH CARE PROXY VS LIVING WILL

While both documents involve health care decisions, a Health Care Proxy appoints an agent to make decisions for you and is typically broader in scope, whereas a Living Will does not appoint an agent and is specific to certain medical conditions. A Health Care Proxy can cover all medical decisions you would make yourself or you can limit those powers however you'd like (surgery, medication, etc...). A Living Will only applies if you are incapacitated due to being in a vegetative state or having a terminal illness likely to result in death in a short period of time. If you are incapacitated and in one of these conditions, the Living Will directs whether you want to receive artificial nutrition and hydration.
